Divorce Court Alimony Shafting
The state of Massachusetts does not hesitate to shaft divorced men.
Steve Niro got married in 1981 at age 23 and divorced less than five years later. At the time of the divorce, he and his wife were in their late 20s, and both were working. Niro remarried nearly 15 years ago, but he’s still paying his alimony.
My advice to young guys: Avoid marriage. It is a bad deal.
About 25 years after the marriage ended this guy gets his alimony payments upped from $65 per week to $700 per week. How incredibly immoral. The youngest son of the marriage is 25 years old.
Two years ago, Niro’s youngest son graduated from college, ending child support payments and leaving his former wife with alimony of $65 a week. “The next thing I know, I get summonsed to court for alimony adjustment,’’ he says. A probate court judge increased the alimony to $700 a week even though the couple had divorced nearly a quarter of a century ago — five times longer than they were married.
Guys, if you want to get married investigate the family and divorce laws of your state. If you intend to marry some day but haven't met the girl of your dreams then move to a state with better divorce laws and look for her there. Or consider moving abroad. Also, a prenuptial agreement is a good idea. Won't entirely eliminate your risk of getting shafted. But better than nothing.
Guys, if you want to get married investigate the family and divorce laws of your state. If you intend to marry some day but haven't met the girl of your dreams then move to a state with better divorce laws and look for her there. Or consider moving abroad. Also, a prenuptial agreement is a good idea.
Or.... you could simply just plan on not divorcing your woman and also being selective and only marry a girl that won't divorce you. Just because 50% of marriages fail doesn't mean there aren't ways to tip the scales in your favor.
Sure, you can tilt the odds in your favor:
- Shyness. Shy girls are less likely to stray.
- Religious girls. Again, less likely to stray.
- Girls from unbroken homes.
- A fat ugly girl.
- Smarts. Dumb people are more likely to divorce.
But how many guys are competent enough to judge their prospective mate's likelihood to want to stay in the marriage and to be faithful?
I expect genetic testing will help in about 5 years.
Well in Mexico marriage is -by law and always- carried out with "Separation of Material Goods" which means that in case of a divorce each one owns only what's under his/her name and in the exact percentage also.
In Mexico a healthy working woman has no right to ask for alimony, except the one for the children under 18. If she has no job at the time of divorce, she is entitled to some of the children's alimony, but only for six months, -time she is given to find a job- After six months the man has no legal alimony obligation to her.
In Mexico if the man is jobless after the divorce and the woman works, the man has the right to demand alimony from her only for six months also, since both men and women have equal rights, and there's no longer any legal form of slavery –including economic slavery- between ex-married ones.
After six months of divorce, alimony continues to be paid -by either man or woman- to the custodian parent/guardian and it is all for the begotten children only.
But then again and like I said, that is in backwards Mexico, where they have these crazy laws of equality between men and women…
